Privacy Policy

This document sets out the rules governing the processing of personal data collected via the website available at dlaprawnika.verificators.com (dalej jako: „Strona Internetowa”).

The entity responsible for operating the website and managing personal data is:

VERIFICATORS LIMITED LIABILITY COMPANY, with its registered office in Warsaw (02-703), ul. BUKOWIŃSKA 8/212, entered in the Register of Entrepreneurs of the District Court for the Capital City of Warsaw in Warsaw, 14th Commercial Division of the National Court Register under KRS number 0000486125, with a share capital of PLN 50,000, Tax Identification Number (NIP): 7962963538, REGON: 146974230, hereinafter referred to as VERIFICATORS Sp. z o.o.

Personal data collected by VERIFICATORS Sp. z o.o. via the Website is processed in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, which repealed Directive 95/46/EC – also known as the GDPR.

VERIFICATORS Sp. z o.o. attaches great importance to protecting the privacy of those who use the Website and takes all necessary measures to ensure the security of Users’ data.

§2 Scope of data processed, purposes and legal basis

VERIFICATORS Sp. z o.o. collects personal data from natural persons who: – carry out legal transactions not directly related to their business activities, – conduct business or professional activities as natural persons, – represent legal persons or organisational units without legal personality which have legal capacity under the law.

In the remainder of this document, all these individuals are collectively referred to as ‘Users’.

Users’ personal data is collected, in particular, in the following cases: a) when using the contact form available on the Website – for the purpose of performing a contract concluded electronically.

The legal basis for data processing is that such processing is necessary for the performance of the contract relating to the use of the contact form (Article 6(1)(b) of the GDPR).

When using the contact form available on the Website, the User may be asked to provide the following details: a) email address, b) first name and surname, c) contact telephone number.

Whilst browsing the Website, the system may automatically collect additional technical data, such as: the IP address of the User’s device or the IP address of their internet service provider, the domain name, the type of browser used, the time of connection to the site and the type of operating system. The Website may also collect data relating to Users’ activity on the site – in particular, information about links clicked and other interactions carried out on the Website.

The legal basis for the processing of this data is the controller’s legitimate interest (Article 6(1)(f) of the GDPR), which consists in improving the functioning of electronic services and enhancing their usability.

In situations relating to the assertion, enforcement or defence against claims, the controller may process selected personal data of the User – such as first name, surname, information regarding the use of services, as well as other data necessary to establish the existence of a claim or to determine its scope, including the amount of damages.

The legal basis for such processing is the controller’s legitimate interest (Article 6(1)(f) of the GDPR), which covers both the assertion of claims and the defence against them before the competent authorities or a court.

The provision of personal data to VERIFICATORS Sp. z o.o. is voluntary.

§3 Udostępnianie danych osobowych i okres ich przechowywania

Users’ personal data may be transferred to entities providing services to VERIFICATORS Sp. z o.o. in connection with the operation of the Website. Depending on the contractual arrangements and the nature of the cooperation, these entities may act as: – data processors (operating in accordance with the instructions of VERIFICATORS Sp. z o.o.), or – data controllers (independently determining the purposes and means of processing personal data).

a) Data processors acting on behalf of the controller – these are companies that process data solely on the basis of explicit instructions received from VERIFICATORS Sp. z o.o.. They include, amongst others, hosting service providers, accountancy firms, and companies providing tools for online marketing, website traffic analysis and the measurement of advertising campaign effectiveness.

b) Data controllers – VERIFICATORS Sp. z o.o. also cooperates with entities that act as independent data controllers, which means that they independently determine the purposes and means of processing Users’ personal data. This group includes, amongst others, payment service providers and banking institutions.

Location of data processing – The entities involved are based both in Poland and in countries belonging to the European Economic Area (EEA).

Retention period for personal data:

a) Where the processing of personal data is based on the User’s consent, such data will be processed by VERIFICATORS Sp. z o.o. until such consent is withdrawn. Following the withdrawal of consent, the data may be retained for a period corresponding to the limitation period for any claims – both those to which the Company may be entitled and those that may be brought against it. In accordance with the relevant legislation, unless otherwise specified, the limitation period is six years, and in the case of periodic claims or those relating to business activities – three years.

b) Where the legal basis for data processing is the conclusion and performance of a contract, the User’s personal data is retained for the period necessary to perform that contract and, thereafter – as above – for a period corresponding to the limitation period for claims arising from the contract. The standard limitation periods are six years, and in the case of periodic claims or those relating to business activities – three years, unless otherwise provided for by specific legislation.

Navigation data may be used to improve the quality of service provided to Users, to carry out statistical analyses, to tailor the Website’s functionality to visitors’ individual preferences, and to manage its operation efficiently.

Should it receive a relevant request or demand, VERIFICATORS Sp. z o.o. may disclose personal data to the relevant state authorities. This applies in particular to the organisational units of the Public Prosecutor’s Office, the Police, the President of the Office for Personal Data Protection, the President of the Office of Competition and Consumer Protection, and the President of the Office of Electronic Communications.

§4 Cookies and IP addresses

This website uses so-called cookies – small files stored on a visitor’s device by VERIFICATORS Sp. z o.o., provided that the web browser settings allow this. A typical cookie contains the name of the domain from which it originates, its expiry date and a unique, randomly generated identifier. The data collected using cookies enables VERIFICATORS Sp. z o.o. to tailor its offering to Users’ preferences and needs, as well as to compile aggregate statistics on visits and interest in the products presented.

VERIFICATORS Sp. z o.o. uses two types of cookies:

a) Session cookies – are stored on the User’s device only until the browser is closed or the computer is switched off. After this time, the information is automatically deleted from the device’s memory. This mechanism does not allow any personal data or other confidential information to be retrieved from the User’s computer.

b) Persistent cookies – are stored in the memory of the User’s device and remain there until they are manually deleted or their expiry date is reached. This type of cookie does not allow any personal data or other confidential information to be obtained from the User’s device.

VERIFICATORS Sp. z o.o. uses its own cookies for the following purposes: a) to carry out analyses, research and audits relating to website traffic, including the compilation of anonymous statistics illustrating how Users use the Website. The information obtained in this way enables the structure and content of the website to be optimised.

VERIFICATORS Sp. z o.o. also uses cookies from third parties for the following purposes:

(a) promoting the Website via the social media platform Facebook.com (these cookies are controlled by Facebook Inc., based in the USA, or Facebook Ireland, based in Ireland);

(b) collecting general, anonymous statistical data using the Google Analytics analytics tool (the cookie controller is Google LLC, based in the USA);

d) managing the newsletter subscription process and its administration, including storing the consents given, the User’s topic preferences, and analysing the effectiveness of email marketing campaigns (including open and click-through rates). The controller of these cookies is GetResponse S.A., with its registered office in Gdańsk (Poland), which provides email marketing services to VERIFICATORS Sp. z o.o. The newsletter is for information purposes only and is sent once or twice a month, covering industry trends and security advice.

The cookie mechanism used on the Website is safe for Users’ devices. It is not possible for a computer to be infected with viruses, malware or other unwanted programmes through this mechanism. However, Users may restrict or completely block the use of cookies in their browser settings. As a result of this decision, they will still be able to use the Website, with the exception of features that require cookies to function properly.

Instructions for changing cookie settings in popular web browsers: a) Internet Explorer, b) Microsoft Edge, c) Mozilla Firefox, d) Chrome and Chrome Mobile, e) Safari and Safari Mobile, f) Opera.

VERIFICATORS Sp. z o.o. may collect Users’ IP addresses. An IP address is a unique number assigned to a visitor’s device by their internet service provider when they visit the Website, enabling them to use the internet. In most cases, it is dynamic, meaning that it changes with every internet connection. This data is used, amongst other things, to diagnose technical problems with the server, prepare statistical analyses (e.g. to identify the regions generating the most traffic on the website), improve the website’s performance, ensure its security, and identify automated tools that crawl content in a way that places an excessive load on the server.

This website may contain links to external websites. VERIFICATORS Sp. z o.o. accepts no responsibility for the privacy policies in force on those websites.

§5 Rights of data subjects

Prawo do wycofania zgody – Legal basis: Article 7(3) of the GDPR. a) The User may withdraw any consent given to VERIFICATORS Sp. z o.o. b) The withdrawal of consent takes effect from the moment it is withdrawn. c) The withdrawal of consent does not affect the lawfulness of data processing carried out prior to that decision. d) Withdrawal of consent does not entail any adverse consequences for the User; however, it may prevent the User from using services or features which, in accordance with the regulations, may only be provided with the User’s consent.

The right to object to the processing of data – Legal basis: Article 21 of the GDPR. a) The user may, at any time, object – on grounds relating to their particular situation – to the processing of their personal data, including profiling, where this is carried out on the basis of a legitimate interest of VERIFICATORS Sp. z o.o.. This applies, amongst other things, to marketing activities relating to the Company’s products and services, statistical analyses concerning the use of the website’s features, improvements to its functionality, and satisfaction surveys. b) Opting out of receiving marketing communications via email regarding products or services will be treated as an objection to the processing of personal data – including profiling – for these purposes. c) Should the objection be found to be justified and VERIFICATORS Sp. z o.o. have no other legal basis for processing the data, the information in question will be deleted to the extent covered by the objection.

The right to erasure (‘the right to be forgotten’) – legal basis: Article 17 of the GDPR. a) The user may request the erasure of all or selected personal data. b) A request for the erasure of data may be made, in particular, in situations where: a. the personal data are no longer necessary for the purposes for which they were collected or for which they were processed; b. the User has withdrawn their consent, if the processing was based on that consent; c. the User has objected to the processing of their data for marketing purposes; d. the personal data has been processed unlawfully; e. the erasure of the data is required to comply with a legal obligation under European Union law or the law of the Member State to which VERIFICATORS Sp. z o.o. is subject; f. the data was obtained in connection with the provision of information society services. c) Even after a request has been made to erase personal data – as a result of an objection or the withdrawal of consent – VERIFICATORS Sp. z o.o. may retain selected information to the extent that its further processing is necessary to establish, exercise or defend legal claims, as well as to fulfil obligations arising from European Union law or national legislation to which the Company is subject. This applies in particular to data such as: first name, surname, email address – stored for the purpose of handling complaints and claims relating to the use of VERIFICATORS Sp. z o.o.’s services – and, in the case of sales or service contracts, also the residential/correspondence address and order number.

The right to restrict data processing – Legal basis: Article 18 of the GDPR. a) The user may request that the processing of their personal data be restricted. Until such a request has been considered, it will not be possible to use certain features or services whose operation requires the processing of the data covered by the request. During this period, VERIFICATORS Sp. z o.o. will also refrain from sending any communications, including those of a marketing nature. b) The User is entitled to request restriction of processing in particular where: a. they dispute the accuracy of their personal data – in which case VERIFICATORS Sp. z o.o. will restrict the processing of such data for the duration of the verification, but for no longer than 7 days; b. the processing is unlawful, but instead of erasing the data, the User requests that its use be restricted; c. the personal data are no longer required by the controller for the purposes for which they were collected, but are required by the User to establish, exercise or defend legal claims; d. the User has objected to the processing of the data – in which case the restriction applies for the time necessary to assess whether, in the given situation, the protection of the User’s rights, freedoms and interests outweighs the interests of the controller processing the data.

Right of access to data – legal basis: Article 15 of the GDPR. a) The data subject may request confirmation from the Controller as to whether their personal data is being processed. If so, they have the right to: a. access their personal data; b. to receive information regarding: the purpose of the processing, the categories of data being processed, the recipients or categories of recipients to whom the data is disclosed, the envisaged period for which the data will be stored (or the criteria used to determine this period where it cannot be unambiguously specified), the rights granted under the GDPR, the possibility of lodging a complaint with a supervisory authority, the source of the data, as well as the principles of automated decision-making – including profiling – and the safeguards applied in the event of data being transferred outside the European Union; c. to receive a copy of their personal data.

The right to rectify data – Legal basis: Article 16 of the GDPR. a) The User may request that the Controller rectify their personal data without delay if it is inaccurate. Taking into account the purposes of the processing, the User also has the right to request that incomplete data be supplemented – including by submitting an additional statement – by sending a relevant request to the email address specified in §6 of this Privacy Policy.

The right to data portability – Legal basis: Article 20 of the GDPR. a) The user has the right to receive from the Controller the personal data they have provided and then transfer it to another controller of their choice. They may also request that the Controller send this data directly to another controller – provided that this is technically feasible. In such cases, the data will be provided in a CSV file, which is a widely used, machine-readable format that allows for the easy transfer of information to another system.

If a User exercises any of the rights described in this Policy, VERIFICATORS Sp. z o.o. will comply with their request or refuse to do so without undue delay, but no later than one month from the date of receipt. Where, due to the complexity of the matter or the number of requests received, it is not possible to comply within this timeframe, the period may be extended by a maximum of a further two months. The User will be informed of the extension and the reasons for it within one month of the date on which the request was submitted.

Users may submit complaints, queries and requests to the Controller regarding the processing of their personal data, as well as the exercise of their rights.

The user has the right to request that VERIFICATORS Sp. z o.o. provide a copy of the standard contractual clauses by submitting a relevant request in the manner set out in §6 of this Privacy Policy.

If a User considers that the processing of their data infringes the provisions of the GDPR or other data protection legislation, they may lodge a complaint with the President of the Office for Personal Data Protection.

§6 Changes to the Privacy Policy

Treść niniejszej Polityki Prywatności może być modyfikowana, o czym VERIFICATORS Sp. z o.o. poinformuje Użytkowników co najmniej 7 dni przed wejściem zmian w życie.
